Notice of Privacy Practices

This notice describes how medical information about you may be used and disclosed, and how you can get access to this information. Please review it carefully.

A Plus Medical Supply is committed to preserving the privacy of your personal health information. We are required by law to protect the privacy of your medical information and to provide you with this notice describing how your medical information is used and disclosed for your treatment, to obtain payment for treatment, for administrative purposes, and to evaluate the quality of care that you receive.

How we use and disclose your information

We use and disclose elements of your Protected Health Information (PHI) in the following ways:

  • Treatment — including providing equipment, supplies and related services to you, and communicating with your treating physician.
  • Payment — including asking about your health care plan or other sources of payment, preparing and sending bills or claims, and collecting unpaid amounts, either ourselves or through a collection agency or attorney.
  • Health care operations — including financial or billing audits, internal quality assurance, personnel decisions, defense of legal matters, business planning, and outside storage of our records.
  • Disclosures where release is authorized by law, including judicial settings and disclosures to health oversight and regulatory agencies, law enforcement and correctional institutions.
  • Uses or disclosures for specialized government functions, including lawful national intelligence activities and military purposes.
  • In emergency situations, or to avert a serious threat to health or safety.
  • If you are a member of the armed forces, we may release medical information about you and your dependents as requested by military command authorities.
  • Disclosures of de-identified information.
  • Disclosures relating to workers’ compensation claims.
  • To medical examiners, coroners or funeral directors to aid in identifying you or to help them perform their duties.
  • To organizations that handle organ and tissue donations.
  • To public health or federal organizations in the event of a communicable disease, or to report a defective device or an adverse event.
  • To business associates who perform services for us and who commit to protect the privacy of your health information.
  • For other purposes where certain laws require or permit us to use and disclose your medical information without your consent or authorization.

If your health information is ever involved in a breach, we will write to you by first-class mail at the address we have on file.

Your rights

To exercise any of these rights, contact our Privacy Officer at (720) 877-7572.

Restrictions

You may request restricted access to all or part of your PHI. We are not required to grant your request, and you do not have the right to restrict disclosures required by law. If we do agree, we must honor the restriction you requested.

Confidential communications

You may ask to receive confidential information by alternative means or at an alternative location — for example, by phoning you at work rather than at home, or mailing to a different address. We will take reasonable steps to accommodate your request.

Access

You may inspect or receive copies of your PHI. In certain limited circumstances you may not have the right to access records, for example information compiled in anticipation of legal proceedings, or information obtained from someone other than a health care provider under a promise of confidentiality where access would be likely to reveal the source.

Amendments and corrections

You may request that we change your PHI. We are not required to grant the request if we did not create the record, or if the record is accurate and complete. If we deny your request we will tell you why, how you can attach a statement of disagreement to your records, and how you can complain. If we agree, we will make the correction within 60 days and send the corrected information to people we know received the incorrect information, and to others you specify.

Accounting of disclosures

You may request a list of disclosures we have made of your PHI. By law the list will not include disclosures for treatment, payment or health care operations, disclosures you authorized, incidental disclosures, disclosures required by law, and certain other limited disclosures. You are entitled to one list per year without charge. We will usually respond within 60 days, and may take one 30-day extension if we notify you in writing.

A copy of this notice

You may ask us for a paper copy of this notice at any time.

Complaints

If you believe your privacy rights have been violated, you may complain to us or to the U.S. Department of Health & Human Services. To complain to us, contact our Privacy Officer at (720) 877-7572 or write to 13780 East Rice Place, Suite 100, Aurora, Colorado 80015.

You may also contact our accrediting organization, HQAA, at 866-909-4722.

The law forbids us from taking retaliatory action against you if you complain.

Other uses need your written permission

Any use or sharing of your health information other than those described above requires your written permission. If you give us permission, you can take it back in writing at any time and we will stop — except where we have already acted on it.

Our duties

We are required by law to maintain the privacy of your protected health information, to give you this notice, and to abide by the terms of this notice or any update to it.

We may change this notice. If we do, the new notice will apply to all health information we hold, and we will post it on this page and give you a copy on request.
